Mitek is seeking an experienced full-time, in-house, privacy and transactional counsel to join its legal team. This person will act as a trusted advisor to our business on privacy, regulatory, and data security matters. Limited travel may be required.

As our Privacy Counsel, you will report to the General Counsel and will play a key role in supporting Miteks global operations, advising the product, sales, and compliance teams with regard to privacy laws and regulations, and Miteks compliance with the same. This role is primarily a privacy-focused role and will be our in-house expert on all privacy-related matters, but will also be called upon to support the business via negotiation of certain commercial contracts.

You will also play a key role in developing, managing and continuing to improve the Companys existing privacy and compliance operations and supporting various customer and vendor transactions in North America and Europe.

This position is eligible for remote work anywhere in the United States, or voluntarily may be based in our San Diego headquarters.

What You’ll Do (Core Responsibilities):

  • Maintain and improve existing global corporate data privacy programs and initiatives as required for a market-leading identity verification and fraud detection company
  • Advise on legal requirements applicable to the processing and controlling of personal information across the companys portfolio of products and services
  • Negotiate various data protection agreements and contract terms in commercial agreements with Miteks customers, vendors, and partners
  • Research, interpret, and provide legal advice on international data privacy and data security laws for new and evolving products, features, functionality, and implementation models
  • Assist in supporting the Companys global commercial contracting activities including customer and vendor agreements.
  • Provide legal advice on a broad range of legal issues including GDPR and global data privacy regulations.
  • Assist with other projects as necessary including general corporate matters.

What You’ll Bring (Required Knowledge, Skills & Abilities):

  • J.D. from an accredited law school and member in good standing of a U.S. state bar, California preferred
  • Minimum of 5 (five) years of experience, primarily focused in data privacy and protection, with a major law firm or as in-house legal in a technology setting
  • Extensive knowledge of global data protection and privacy laws, including GDPR, CPRA, COPPA, Gramm-Leach-Bliley, LGPD, PIPEDA, and other global privacy laws and regulations
  • Significant experience negotiating DPAs and other privacy-oriented commercial agreements, particularly those related to SaaS software offerings
  • General experience negotiating commercial sales and purchasing contracts
  • Extensive career experience advising on compliance matters including compliance with GDPR and global data privacy regulations.
  • CIPP/E, CIPP/US, CIPP/C, CIPP/A or equivalent preferred; additionally, CIPM, CDPO, CDP, CISSP or similar certifications a plus
  • Strong interpersonal, negotiating and organizational skills.
  • High degree of professional ethics and integrity.
  • Excellent judgment and ability to operate independently in a fast-paced, small legal department on a broad range of matters.
